Slovenia

Company registration number: 8702403000

The online store is available at https://elato-pet.com/.

These Terms & Conditions govern the operation of the Elato online store, the purchasing process, the rights and obligations of the provider and the customer, and other matters related to the purchase of products through the online store.

For consumers, the applicable laws of the Republic of Slovenia and the European Union apply, in particular the Consumer Protection Act (ZVPot-1).

  1. Orders and Conclusion of the Contract

The customer selects products, adds them to the shopping cart and, before placing the order, reviews all essential order details, including the products, quantities, prices, delivery costs and the total amount payable.

Before completing the order, the customer is informed of these Terms & Conditions and other information relevant to the conclusion of the contract.

By placing an order that entails an obligation to pay, the customer confirms that they wish to conclude a contract for the purchase of the selected products.

After the order has been successfully placed, the customer receives an acknowledgement of receipt or confirmation of the order at the e-mail address provided.

If the order cannot be fulfilled due to product unavailability, an obvious pricing error or other justified reasons, the provider will inform the customer as soon as possible. If the order has already been paid, the provider will refund the payment received.

Order data is stored in the provider’s information system in accordance with applicable law and the Privacy Policy.

  1. Prices

All prices in the Elato online store are stated in euros (EUR) and include VAT, unless expressly stated otherwise.

The price applicable to the customer is the price displayed at the time the order is placed.

Delivery costs, where applicable, are shown separately before the order is completed and are included in the total order amount.

The provider reserves the right to change prices. Price changes do not affect orders that have already been placed.

In the event of an obvious error in the price or other essential product information, the provider will inform the customer of the error and allow the customer to purchase under the correct conditions or cancel the order.

  1. Payment Methods

Available payment methods are displayed to the customer during the checkout process.

The online store allows payment with supported payment or credit cards through the WooPayments payment system.

Depending on the device used, browser, country and other conditions of the payment service provider, supported digital wallets such as Apple Pay and Google Pay may also be available.

Payment transactions are processed by external payment service providers in accordance with their own terms and security standards. The provider does not have access to the customer’s complete payment card details.

An order is deemed paid when the provider or the payment service provider receives the appropriate confirmation of payment.

  1. Delivery

Delivery is available to areas or countries shown as available delivery destinations during the checkout process.

Available delivery methods and their costs are displayed to the customer before the order is placed.

Delivery costs depend on the destination, order value or other characteristics of the order, and the selected delivery method.

Where free delivery is available above a certain order value, the relevant condition is displayed in the online store or during the checkout process.

Products in stock are generally prepared and dispatched as soon as possible.

The estimated delivery time is displayed or communicated to the customer depending on the selected delivery method and destination. Unless otherwise agreed, the provider will fulfil its obligation without undue delay and no later than 30 days after the conclusion of the contract.

If an ordered product cannot be delivered, the provider will inform the customer as soon as possible.

The risk of loss of or damage to the goods passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, physically receives the goods.

  1. Consumer’s Right of Withdrawal

In the case of a distance contract, the consumer has the right to inform the provider within 14 days of receiving the goods that they are withdrawing from the contract, without having to give a reason for the decision.

The notice of withdrawal may be sent to info@agoravet.net. A clear and unambiguous statement by the consumer is sufficient. The consumer may also use the withdrawal form published on the website.

The consumer must return the goods without undue delay and no later than 14 days from the date on which the provider was informed of the withdrawal.

The direct cost of returning the goods is borne by the consumer, unless the provider expressly determines otherwise or the consumer was not informed of this obligation in advance.

The consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

The right of withdrawal does not apply in the cases provided for by ZVPot-1. For individual products, this may include, among other things, goods that are liable to deteriorate or expire rapidly, and sealed goods which are not suitable for return due to health protection or hygiene reasons if the consumer has unsealed them after delivery and the statutory conditions for applying the exception are met.

More detailed information on the return procedure is available on the Returns & Right of Withdrawal page.

  1. Refunds Following Withdrawal

In the event of a valid withdrawal from the contract, the provider will refund the consumer, without undue delay and no later than 14 days after receiving the notice of withdrawal, all payments received, including the cost of the least expensive standard delivery method offered by the provider for the order concerned.

The refund is generally made using the same payment method used by the consumer, unless the consumer expressly agrees to another method of refund and does not incur any additional costs as a result.

The provider may withhold the refund until the returned goods are received or until the consumer provides evidence that the goods have been sent back, unless the provider collects the returned goods itself.

The consumer is not entitled to reimbursement of additional delivery costs incurred because the consumer expressly chose a more expensive delivery method than the least expensive standard delivery method offered by the provider.

  1. Conformity of Goods and Complaints

The provider is responsible for the conformity of the goods in accordance with applicable consumer protection legislation.

If the product received does not conform to the contract, is damaged, incorrectly delivered or has another defect, the customer may notify the provider at info@agoravet.net.

The notice should include the order number, a description of the problem and, where possible, photographs of the product or packaging.

In the event of non-conformity of the goods, the consumer has the rights provided by ZVPot-1, including the right to request that conformity be restored free of charge where possible or, subject to the statutory conditions, replacement of the product, a proportionate reduction in the purchase price, or withdrawal from the contract and refund of the amount paid.

If the non-conformity of the goods becomes apparent within less than 30 days from delivery, the consumer may, subject to the conditions of ZVPot-1, withdraw from the sales contract and request a refund of the amount paid.

The exercise of rights arising from non-conformity of the goods is free of charge for the consumer.

The provider will handle the complaint without undue delay and inform the customer of the further procedure or proposed solution.

  1. Personal Data Protection

The provider processes the personal data of customers and other website users in accordance with applicable personal data protection legislation. More detailed information on the categories of personal data, purposes and legal bases of processing, recipients of data, retention periods and the rights of individuals is provided in the Privacy Policy.

  1. Cookies

The website uses cookies that are necessary for its operation and may, with the user’s appropriate consent, also use other types of cookies. More detailed information on the use of cookies is provided in the Cookie Policy.

  1. Out-of-Court Resolution of Consumer Disputes

The provider endeavours to resolve any disputes and complaints amicably. The consumer may submit a complaint by e-mail to info@agoravet.net.

In accordance with the Out-of-Court Resolution of Consumer Disputes Act (ZIsRPS), AGORAVET, pakiranje, d.o.o. does not recognise any provider of out-of-court consumer dispute resolution as competent to resolve a consumer dispute that the consumer may initiate in accordance with that Act.

If an amicable resolution of the dispute is not possible, disputes will be resolved before the court having subject-matter and territorial jurisdiction in accordance with applicable law.

  1. Language

The Elato online store is available in Slovenian and English.

These Terms & Conditions are prepared in Slovenian and may also be published in an English translation.

In the event of any discrepancy between the Slovenian version and a translated version, the Slovenian version shall prevail to the extent permitted by applicable law.

  1. Amendments and Validity of the Terms & Conditions

The provider reserves the right to amend or supplement these Terms & Conditions due to changes in business operations, online store functionality or applicable law.

Amendments enter into force on the date of publication on the website, unless otherwise specified.

The terms applicable to an individual order are those in force at the time the order was placed.

These Terms & Conditions apply from the date of their publication on the website.
